Mandatory requests from the National Institute for Health and Care Excellence (NICE)

Section 255 of the Health and Social Care Act enables the National Institute for Health and Care Excellence (NICE) to make a request to HSCIC (now known as NHS Digital) on matters concerning the provision of health services or adult social care.

NICE can request that NHS Digital put in place systems to collect and analyse information. This is known as a mandatory request as NHS Digital must comply unless we consider the request relates to information that is prescribed in regulations. No such regulations have been made as yet.

1 February 2023 update - The statutory functions of NHS Digital transferred to NHS England under the Health and Social Care Information Centre (Transfer of Functions, Abolition and Transitional Provisions) Regulations 2023 (Transfer Regulations) with effect from 1st February 2023 (Transfer Date).

Where NHS Digital was required to or previously accepted a request under section 255 of the Health and Social Care Act 2012 to establish and operate an information system, that request is regarded under the Transfer Regulations as a request made to and accepted by NHS England.
