Data Provision Notices (DPNs)

When we are directed or requested to establish information systems for the collection and analysis of information under sections 254 and 255 of the Health and Social Care Act 2012, we issue a Data Provision Notice (DPN) to those organisations from whom we need to collect the required data.

A DPN is a formal notice we publish when we exercise our powers under sections 259(1)(a) and 259(1)(b) of the 2012 Act, which requires those health and social care bodies in England who are identified in the DPN to provide us with data we require. In some circumstances we may only request other bodies to provide the data, including health and care bodies in Scotland, Wales or Northern Ireland. The DPN will make clear whether an organisation is legally required to supply the data, or is being requested to do so only. In either case, when data is provided in response to a requirement or a request made under section 259, the data can be supplied without breaching the common law duty of confidentiality.

Updates

1 February 2023: The statutory functions of NHS Digital transferred to NHS England under the Health and Social Care Information Centre (Transfer of Functions, Abolition and Transitional Provisions) Regulations 2023 (Transfer Regulations) with effect from 1st February 2023 (Transfer Date).

Under the Transfer Regulations, all directions by either the Secretary of State or NHS England to NHS Digital are now regarded as if they were directions made by the Secretary of State to NHS England.

Where NHS Digital was required to or previously accepted a request under section 255 of the Health and Social Care Act 2012 (2012 Act) to establish and operate an information system, that request is regarded under the Transfer Regulations as a request made to and accepted by NHS England.

Under the Transfer Regulations, all Data Provision Notices previously issued by NHS Digital under section 259 of the 2012 Act are regarded as Data Provision Notices issued by NHS England. All Data Provision Notices continue in force and all data collections required under them continue in force unless and until any Data Provision Notice is amended or withdrawn. All Data Provision Notices issued by NHS England after the Transfer Date will continue to be published here.

30 June 2022: In accordance with the Health and Care Act 2022, as of 1 July 2022, CCGs are abolished and their statutory obligations will be managed by Integrated Care Boards. These obligations include the continuing requirement to submit data to NHS Digital as set out in a Data Provision Notice. This has been confirmed in communication with individual submitting organisations for relevant collections and the supporting Notices will be formally updated on the next version of each collection.
